General terms and conditions

These General Terms and Conditions (hereinafter referred to as the “GTC”) set out the rules for purchases made through the online store operated by EN-TAN Kft. (hereinafter: the “Service Provider”) on the website www.fonal8.hu (the “Webshop”), including rules relating to the operation of the Webshop, orders and fulfilment, and the rights of the customer.

Through the Webshop, the parties conclude individual sales contracts for the purchase of products. Each sales contract is established for a specific performance—namely, the transfer of ownership of the product(s) ordered by the buyer (hereinafter: the “Customer”)—excluding any time limits applicable to the Customer’s right to enforce claims resulting from non-performance, late or defective performance, or breach of contract by the Service Provider.

In case of purchasing goods through the Webshop, a typical consumer contract is concluded between the parties without simultaneous physical presence, using a distance communication tool that enables the making of contractual declarations for the purpose of concluding a contract. For the purposes of the Webshop, such communication is conducted electronically via internet through computer and/or other mobile devices operated by the parties.

We kindly ask that if you wish to become a customer or an active user of the Webshop, read these General Terms and Conditions carefully and only use our services if you agree with all of its provisions and accept them as binding. By using the Webshop, users accept that the provisions of these General Terms and Conditions shall apply to them. These GTC shall apply to all uses of the Webshop, including browsing that does not result in a purchase.

Order Process and Order Fulfilment

1. Product Selection

To start shopping, it is not necessary for the Customer to be a registered user. Registered users may log in to their accounts before beginning a purchase, or choose to proceed as a guest without logging in or registering.

The Customer can browse and select from the products available in the Webshop. By clicking on a selected product, the Customer can view detailed information about it. If the Customer wishes to purchase the item, it can be added to a virtual cart by clicking the “Add to Cart” button.

By clicking the “Cart” icon, the Customer can review the selected items and see the total amount of the order. At this stage, the Customer may verify the accuracy of the order, especially the prices and quantities, which can be adjusted or corrected as needed. The cart automatically calculates the total value of the order.


2. Submitting the Order

If the Customer finds the cart contents correct, has reviewed the total amount, and decides to proceed with the purchase, they can simply click the “Checkout” button.

Customers who proceed without logging in must provide their billing and shipping information. After that, the Customer can choose the preferred shipping and delivery method. The system will automatically update the total amount with the applicable shipping fee.

Once the shipping method is selected, clicking the “Continue” button will allow the Customer to choose from the available payment methods. For cash-on-delivery orders, an additional COD fee is added to the total, which is automatically calculated by the system. (Currently, the Webshop only accepts payment via credit/debit card, bank transfer, or online payment via WebPay.)


3. Finalizing the Order and Payment

At every step of the process, the Customer has the option to go back and make changes until reaching the final “Review and Confirm” page. Here, by accepting the Terms and Conditions and optionally subscribing to the newsletter, the Customer can finalize the order by clicking the “Place Order” button. This redirects them to the selected online payment system (e.g., card payment or WebPay).


Pricing

All prices displayed in the Webshop are valid at the time the order is placed and are shown next to the respective products. All prices are gross prices (including VAT), but they do not include delivery costs. Delivery costs are displayed on the product page, during checkout before the order is finalized, and also listed in these General Terms and Conditions.

In case of any error or deficiency regarding product prices or descriptions in the Webshop, the Service Provider reserves the right to correct such errors. If a correction is necessary, the Customer will be informed immediately, and may then reconfirm the order, or either party may withdraw from the contract.

Order processing is partly manual and partly automated. Manual processing takes place on business days between 10:00 and 16:00. Automated processing (except during planned or unplanned outages) is available 24/7. Orders can be placed 24/7, excluding scheduled maintenance periods or unexpected downtime.

After placing an order, the Customer will receive an automatic confirmation email with the order details and estimated delivery time. If this confirmation is not received within 48 hours (and is not located in the spam or junk mail folder), the Customer should contact the Service Provider using one of the provided contact options. The Service Provider is not liable for failed confirmations due to incorrect customer data or issues related to the recipient’s email system.


Correction of Input Errors

The Customer may correct any input errors only before clicking the “Place Order” button.

Customers may also report input errors via the Contact Form available on the website, or initiate coordination through this platform.

Shipping Conditions

The delivery of orders is carried out by our contracted couriers, packaged in cardboard boxes. The estimated delivery time is indicated during the checkout process and also confirmed in the order confirmation email.

Customers may inquire about the delivery date via the phone number included in the confirmation email or through the tracking links provided by the courier services.

Available delivery methods:

  • Home delivery

  • Delivery to parcel points (lockers)

Deliveries are made on working days, Monday through Friday. Orders must be submitted at least 72 hours prior to the delivery day to be considered valid.

The standard delivery fee is 15,99€ per delivery, but may vary according to the current price list published on the Webshop’s website. The Service Provider reserves the right to change the shipping fees.

Any additional delivery-related costs beyond the standard fee shall be covered by the Service Provider.

Both home and workplace addresses are accepted as valid shipping destinations. The shipping address may differ from the billing address. We recommend specifying a location where someone is most likely available to receive the package at the expected time of delivery.

The delivery is executed by a contracted courier service. The courier delivers the goods to the address provided by the Customer, verifies the necessary customer data, and collects the payment (in case of cash on delivery). The courier operates under a confidentiality agreement with regard to the storage, processing, and handling of personal data.

Please ensure that the delivery address provided allows for the safe receipt or storage of the shipment.

We strongly recommend that you inspect the package upon delivery in the presence of the courier. If any damage is visible on the product or packaging, please request that a written report be prepared on site. The Customer is not obliged to accept damaged goods or packaging. The Service Provider is not obligated to accept damage claims submitted later without an official damage report.


Right to Cancel Delivery

If the Webshop is unable to fulfill the order due to unavailability of the specified goods or services, the Customer shall be notified accordingly. The Webshop does not conclude contracts with minors. By accepting the commercial terms, the Customer confirms that they are of legal age.


Methods of Payment and Terms

The Customer’s payment obligations related to the sales contract include:

  1. The purchase price of the product

  2. Delivery and handling charges

  3. Optional packaging and COD fees

No other fees will be charged by the Service Provider to the Customer.

The costs of remote communication (e.g. internet access, telephone charges) are borne by the party incurring the cost.

The final payable amount (including all charges) is clearly shown in the order summary and confirmation email.

All prices, including delivery and handling fees, are listed in Hungarian Forint (HUF) or Euro (EUR) and include the applicable VAT.

The Service Provider may issue an electronic invoice to the Customer’s email address following the order. Accepting these GTC constitutes acceptance of the electronic invoice format. This consent can be withdrawn by sending an explicit written request to the Service Provider.

If an e-invoice is issued, it will comply with relevant accounting and tax legislation and be sent electronically to the Customer’s specified email address.


Accepted Payment Methods

  • Bank Transfer (Prepayment): After placing an order, the Seller will issue a pro forma invoice via email. Upon receipt of the transfer, the Seller proceeds with shipping and issues an invoice electronically.

  • Cash on Delivery: The total purchase amount (including delivery fee) is paid to the courier upon receipt, either in cash or by card. This method includes an extra handling fee.

  • Credit/Debit Card Payment: No registration is required. However, to process the transaction securely, the Customer must provide their name, card number, expiration date, CVV code, and a valid email address.

Right of Withdrawal / Return Policy

To preserve the quality of the purchased product, the Customer is responsible for ensuring proper storage after receiving the product.

Following the conclusion of the contract, the Customer is entitled to withdraw from the contract and return the product within 14 days, based on Section 29 of Government Decree 45/2014 (II.26.).

Order Modification and Cancellation

In accordance with Act CVIII of 2001, upon submitting an order, the Webshop’s system automatically sends a notification to the Customer confirming that the order has been received.
This notification does not constitute a contract between the Seller and the Customer – it merely informs the Customer that the order request has been registered and forwarded to the responsible employee.

If the Customer does not receive this confirmation within 48 hours, their obligation to maintain the order lapses.

The Seller allows the Customer to withdraw the order until the order processing has started, by notifying the Seller electronically. Once the order is in processing, the Customer will receive a notification by email and/or phone including the expected delivery time and confirmation of fulfillment.
From that point, cancellation is only possible via the “Customer Service” or “Contact” options on the website.

Orders can only be modified in writing via email, and only up to 12 hours before the scheduled delivery.

By placing the order (clicking on the “Submit Order” button), the Customer automatically accepts the Webshop’s Terms and Conditions.

Applicable Law

The present General Terms and Conditions, as well as the legal relationship between the Parties governed by and in accordance with these GTC, shall be governed by Hungarian law, with special regard to the following legislation:

  • Act V of 2013 on the Civil Code (the “Civil Code”);

  • Act CVIII of 2001 on certain issues of electronic commerce services and information society services (“E-commerce Act”);

  • Act CLXIV of 2005 on Trade (“Trade Act”);

  • Act XLVIII of 2008 on the Basic Requirements and Certain Restrictions of Commercial Advertising Activities (“Advertising Act”);

  • Act CXII of 2011 on the Right to Informational Self-Determination and on Freedom of Information (“Privacy Act”);

  • Government Decree 151/2003 (IX.22.) on mandatory warranty for certain durable consumer goods;

  • Government Decree 210/2009 (IX.29.) on the conditions for carrying out commercial activities;

  • Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses;

Information on Contract Conclusion

This document is not registered, it is concluded exclusively in electronic form, and does not constitute a written contract. The contract is concluded in the Hungarian language. It does not refer to any code of conduct.

If any provision of this Agreement becomes invalid, illegal, or unenforceable, it shall not affect the validity, legality, or enforceability of the remaining provisions.


Retention of Ownership

Ownership of the delivered goods remains with the Seller until full payment of the purchase price has been received. In case of erroneous or unconfirmed orders, the product is restocked under the name of the “new” owner and the consideration is only paid out after a successful resale.

Effective Date

These General Terms and Conditions enter into force on February 24, 2024, and shall remain valid until amended or withdrawn.
