Terms of Use

The following General Terms and Conditions (GTC) contain the rules for purchasing (including the operation, orders, and fulfillment of the Webshop) on the website www.fonal8.hu operated by EN-TAN Kft. (hereinafter: the "Service Provider"), as well as the rights entitled to the buyer.

Through the Webshop, the parties enter into contracts for the individual sale of products. The individual sales contracts are concluded for a definite period, namely to provide ownership of the products ordered by the buyer (hereinafter: the "Buyer"), excluding deadlines open for the enforcement of buyer claims resulting from the Service Provider's non-performance, delay, or defective performance or breach of contract.

When purchasing goods through the Webshop, typically, a consumer contract is concluded within the framework of a distance selling system organized for the provision of the product as per the contract, without the simultaneous physical presence of the parties, whereby the contracting parties, solely for the purpose of concluding the contract, utilize means of remote communication among absentees, i.e., means capable of allowing the parties to make contractual statements in their absence, such as the electronic, internet-based connection operated by the parties via computer and/or other mobile devices.

Please carefully read the General Terms and Conditions if you wish to be a buyer or an active user of the Webshop, and only use our services if you agree with all its points and consider them binding on yourself. Users accept that the General Terms and Conditions govern their use of the Webshop. Regardless of the manner of use of the Webshop - including views that do not result in a purchase - the provisions of the General Terms and Conditions shall apply.

1. Product selection

Customers do not need to be registered shoppers to begin a purchase. Our registered customers can log into their accounts before starting their purchase, or they can choose the option of shopping without logging in, which is also available to non-registered shoppers.

Customers have the option to browse and order from the products available in the store. By clicking on a selected product, customers can view its detailed description. If they wish to purchase the item, they can add it to their virtual shopping cart by pressing the "Add to Cart" button. Clicking on the "Cart" button allows customers to view the items placed in their virtual shopping cart during the purchase process, as well as the total bill. Here, customers can review the accuracy of their order, especially regarding prices and quantities, which they can modify or correct as needed. The cart automatically calculates the total amount of the order.


2. Sending the order

If the customer finds the contents of the cart satisfactory, has checked the total amount, and decides to purchase the selected item(s), they simply click the "Checkout" button. For those customers who are using the Webshop service without logging in, they will need to provide billing and delivery address details at this point. They can then choose the type of delivery or product pick-up they prefer. The cart automatically displays the total bill including shipping charges at the end of the summary.

After determining the shipping method, customers can select a payment method by clicking the "Continue" button. In the case of cash on delivery payment, the product can be purchased for an additional cash on delivery fee, which the system automatically calculates and adds to the total bill when selecting cash on delivery. (Currently, the Webshop only accepts electronic payment methods such as credit/debit card, bank transfer, or webpay.)

3. Order finalization and payment

The customer can choose to withdraw at every step of the process, while before finalizing the order, on the last "Overview and confirmation" page, with the indication of acceptance of the terms and conditions, as well as the option to subscribe to the newsletter, with the "Finalize the order" button, in accordance with his previous choice of bank card or Webpay payment we direct it into the system.

Prices:

Our prices are the list prices valid at the time of ordering, which can be found next to the products in the webshop. The prices are gross prices, including VAT, but they do not include shipping costs. The shipping cost is indicated on the product page, during the checkout process before finalizing the order, and also in the General Terms and Conditions. In case of any errors or deficiencies in the products or prices in the webshop, we reserve the right to make corrections. In such cases, after recognizing or modifying the error, we will immediately inform the customer about the new data. Following this, the customer can confirm the order again, or either party has the option to cancel the contract.

Order processing is carried out partly through personal involvement and partly through automated data processing. Personal processing of orders takes place on weekdays from 10:00 to 16:00, while processing with automated tools, excluding planned and unplanned downtimes, is available 24/7. Orders can be placed 24/7, excluding the time of planned and unplanned downtimes.

We will confirm your order via email to the provided email address. This means that after submitting the order, you will receive an automatic email confirming the receipt of the order and the expected delivery time. The purchasing process is completed with the delivery of the confirmation email. If you do not receive this confirmation within 48 hours (and it has not been automatically placed in your spam folder), please contact us through one of our contact channels. The Service Provider disclaims responsibility for the undeliverability of the confirmation due to inaccuracies in the data provided by the customer or saturation of the email system.


Possibility to correct data entry errors

Data entry errors can only be corrected before pressing the "Order" button.

You can report your data entry problem to us in writing on the Contact form on the website, which you can also initiate a consultation on this platform.

In the case of a phone consultation, call customer service or any of the phone numbers in the e-mail.

Conditions of Carriage

The delivery of shipments is carried out by contracted couriers, packaged in cardboard boxes. The delivery time of the product is provided by the webshop during the checkout process, and it is also included in the confirmation email. You can arrange the delivery time by contacting the phone number provided in the confirmation email, or through the courier service's website equipped with a tracking link for orders.

Delivery methods: Home delivery or delivery to a parcel locker (parcel machine).

Deliveries are made from Monday to Friday, on business days. Orders must be placed at least 72 hours before the delivery date to be considered valid.

The delivery cost is 3990 Hungarian Forints per delivery. We reserve the right to make changes.

Any additional costs beyond this will be covered by the Service Provider.

The delivery address can be either a residential or workplace address. The delivery address can differ from the billing address. It is advisable to provide a delivery address where someone will likely be present during the expected delivery time.

The delivery is carried out by the Carrier contracted by the Service Provider. The Carrier delivers the goods provided by the Service Provider to the address specified by the customer, checks the necessary customer data, and receives the payment for the goods - in the case of cash on delivery payment. The Carrier performs its activities with complete confidentiality regarding the storage, processing, and management of data.

Please ensure that you provide a delivery address during the ordering process where continuous receipt of the product is guaranteed, or where storage is arranged.

Upon delivery, please inspect the package in the presence of the Carrier. If you notice any damage to the products or packaging, request the drafting of a report. The customer is not obligated to accept a damaged package or product. The Service Provider is not obligated to accept complaints made after delivery without a report.


Cancellation of delivery:

If the Webshop fails to fulfill its obligations as stipulated in the contract due to the unavailability of the specified goods or the inability to provide the ordered service, it is obligated to inform the customer. The Webshop does not enter into contracts with minors. By accepting the terms and conditions, the customer also declares themselves to be of legal age.

Payment Methods and Payment Conditions: The costs incurred by the buyer in connection with the purchase are (1) the price of the product, (2) the shipping and handling costs, and (3) any packaging and cash on delivery charges. The Service Provider does not impose any additional costs or fees on the customer.

The costs of communication between remote parties (electronic data connection, telephone call charges) are borne by the party incurring the cost. The total amount to be paid includes all costs based on the summary of the order and the confirmation email.

The prices of the products available in the Webshop, as well as the shipping and handling costs, are always determined in Hungarian Forints and include the applicable value-added tax amount.

After sending the order, the Service Provider can issue an electronic invoice to the customer's email address for payment confirmation. Acceptance of these General Terms and Conditions constitutes consent to accept electronic invoices. To withdraw this consent, the customer can submit a clear statement of withdrawal to the Service Provider. Once the customer's e-invoice is ready, in accordance with accounting and tax regulations, the Service Provider sends the invoice, containing the required data, to the customer's designated email address in electronic invoice format.

PAYMENT METHODS:

  • Bank Transfer: After placing the order, the Seller issues a pro forma invoice for bank transfer, and then sends a copy of it electronically (via email) to the Buyer. Upon receipt of the purchase price on the Seller's bank account, the Seller arranges the delivery of the ordered Products and sends the original invoice to the Buyer electronically.

  • Cash on Delivery: The full purchase price, including the shipping cost, must be paid in cash or by credit/debit card to the courier upon receipt of the shipment. Cash on delivery entails an additional cost for the Buyer.
  • Credit Card Payment: Registration is not mandatory for credit card payments. However, to ensure a successful purchase, it's necessary to provide the required information for billing and card acceptance. You'll need to provide the name on your credit card, card number, expiration date, CVC code found on the back, and a valid email address. >>


Right of withdrawal/ Return guarantee

In order to prevent deterioration of the purchased product, the customer must ensure proper storage after receiving the product.

45/2014, the Customer can withdraw from the contract and return the product. (II.26.) Cor. is entitled under § 29 of the decree. If you have any comments regarding the quality of the delivered products, please contact our customer service.


Modifying or canceling an order

Under the Act CVIII of 2001, upon placing an order, the seller's Webshop software immediately sends a notification to the buyer confirming the receipt of the order. This notification does not constitute a contract between the seller and the buyer! It simply informs the buyer that their order request has been registered in our system and forwarded to the relevant staff member of the seller.

If the buyer does not receive this notification within 48 hours, their offer obligations cease.

Until the seller initiates the fulfillment of the order, the buyer is provided with the opportunity to cancel their order electronically. Once the order fulfillment begins, the buyer receives notification via email and/or phone regarding the expected duration of fulfillment and the commencement of fulfillment. After this point, cancellation can only be done in person or through one of the contact options found under the "Customer Service" or "Contact" sections.

Any subsequent modifications to the order can only be made in writing via email within 12 hours prior to the delivery date.

By ordering products (by clicking the "Submit Order" button), the buyer automatically accepts the purchase terms.

Governing law

Subject to these General Terms and Conditions, as well as the General Terms and Conditions, the legal relations of the Parties are governed by Hungarian law, in particular

  1. Act V of 2013 on the Civil Code (the "Ptk.");
  2. CVIII of 2001 on certain issues of electronic commercial services and services related to the information society. law (the "Ekertv.");
  3. CLXIV of 2005 on trade. law (the "Garden");
  4. XLVIII of 2008 on the basic conditions and certain limitations of economic advertising. Act (the "Grt.");
  5. CXII of 2011 on the right to information self-determination and freedom of information. law (the "Infotv.");
  6. 151/2003 on the mandatory warranty for certain consumer durables. (IX. 22.) Government decree;
  7. Government Decree 210/2009 (IX. 29.) on the conditions for conducting commercial activities;
  8. Government Decree 45/2014 (II. 26) on the detailed rules of contracts between the consumer and the business;
  9. NGM Decree 19/2014 (IV. 29.) on the procedural rules for managing warranty and guarantee claims for things sold under a contract between a consumer and a business;

Contractual terms disclosure:

This document is not registered, it is concluded solely in electronic form, does not qualify as a written contract, is written in Hungarian, and does not refer to a code of conduct.

If any part of this Regulation becomes invalid, unlawful, or unenforceable, it shall not affect the validity, legality, or enforceability of the remaining parts.

Ownership clause: 

The delivered goods remain the property of the supplier until the full payment of the purchase price. In the case of incorrect or unacceptable orders, the product is inventoried under the name of the "new" owner, and after a subsequent successful sale, the consideration is paid to the new owner!

These General Terms and Conditions shall enter into force as of February 24, 2024, and shall remain in force until amended or revoked.
